1. Acceptance of terms
By accessing or using StableGate Gardening Academy services, websites, and course materials (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.
2. Eligibility and accounts
You must provide accurate and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, applicable law, or platform integrity and safety requirements.
3. Content, ownership, and license
All course videos, texts, worksheets, images, branding, and other materials provided through the Services (“Content”) are owned by StableGate or its licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial educational purposes only.
You may not copy, reproduce, distribute, publicly display, publicly perform, resell, sublicense, share access, scrape, or create derivative works from the Content, except as expressly permitted in writing by StableGate.
4. User submissions
If you submit comments, assignments, photos, or other materials (“Submissions”), you represent you have the rights to do so. You grant StableGate a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display such Submissions solely for operating and improving the Services, including for course feedback, community learning features, and support.
Do not post content that is unlawful, harmful, harassing, infringing, or otherwise inappropriate.
5. Payments, taxes, and refunds
Prices are shown before checkout. You agree to pay all applicable fees and taxes. Payment processors may require additional information to complete a purchase.
Refund eligibility and timing follow our policy described in the FAQ or purchase flow presented at the time of purchase. If a refund is issued, access to the refunded Content may be revoked.
6. Acceptable use
You agree not to:
- Use the Services for illegal, fraudulent, or abusive activity.
- Attempt to gain unauthorized access to accounts, systems, or networks.
- Interfere with or disrupt the Services, including by introducing malware or automated scraping.
- Misrepresent your identity or affiliation.
- Harass, intimidate, or discriminate against others.
7. Third-party services and links
The Services may include features provided by third parties (such as payment processing or embedded tools). Your use of third-party services may be subject to their own terms and policies. StableGate is not responsible for third-party services not controlled by us.
8. Disclaimers
The Services and Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, StableGate disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Gardening outcomes vary based on climate, soil, pests, plant varieties, watering, and individual practice. Educational content is general information and does not guarantee results.
9. Limitation of liability
To the fullest extent permitted by law, StableGate and its affiliates, instructors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from or related to your use of the Services or Content.
To the fullest extent permitted by law, StableGate’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to StableGate for the specific Service giving rise to the claim in the 12 months preceding the event.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access to the Services (including Content access) if you violate these Terms, if required by law, or to protect the security and integrity of the Services.
11. Changes to these Terms
We may update these Terms from time to time. We will update the “Effective date” above. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
